It is not possible for a company registered in Hong Kong to hire an employee in Mainland China. In fact, at the level of immigration and labor law, China and Hong Kong are effectively two different countries.
There are 3 options for hiring employees in China:
- Create a company in China (WOFE);
- Open a representative office of your Hong Kong company in China (attention: Hong Kong company must be at least 3 years old);
- Use a payroll company that will hire the employee and invoice your company in Hong Kong for their salary and social charges.
